Making a Health and Welfare Deputy Application

When thinking about becoming a health and welfare deputy on behalf of someone lacking sufficient understanding there are several points to consider.

  1. Are you already involved in making health and welfare decisions for them?
  2. Are you the most appropriate person who has the suitable skills and abilities to be the health and welfare deputy?
  3. Do your answers to the above questions align with legislation, case law and what the Mental Capacity Act 2005 Code of Practice says about being a suitable person to be a health and welfare deputy?

The court will need to be persuaded that a health and welfare deputy order should be granted to you. They are more likely to grant you a health and welfare deputy order for someone who has never had sufficient mental capacity or understanding. It would still require evidence in the form of statements from yourself and other people involved in the health and welfare situation to show why a health and welfare deputy application should be granted to you.
